Appeal to the Peace Officer

 

The offender or other  person liable for the payment of the report can present an appeal to the relevant Peace Officer within 30 days from the challenge or notification of  violation report.

The appeal can be filed to the the Justice's  office by the applicant or his deputy or it sent by international registered post. Some Justice's office are also authorized to present the appeal electronically.

It is not permitted to present the appeal  if the violation report is paid. The payment of the fine is the accepting the violation report.

Please note – The appeal to the Peace Officer  is unacceptable  , if the appeal has been presented  before  to the Prefect

The appeal to the Peace Officer is presented persuant to ways and procedure  to artt. 22 and 23 of L. 24 November 1981 n. 689, except certain specific exemptions persuant to`art. 204 bis D.lgs 30 April 1992 n. 285.

Unified contribution

To appeal to Peace Officer  must pay  the fee so-call "contributo unificato" with a  revenue stamp of € 27. The payment can be done to:

  • Post offices with postal report ;
  • banking institutions with "modello F23";
  • authorised tobacco stores.

The amount of the fee "contributo unificato" depends on amount of violation report. For fines of amount up to € 1.100 the fee "contributo unificato" is  € 43; for fines of amount  between € 1.100 and € 5.200 is € 98.

What can decide the Peace officer

The Peace Officer orders to the authority to deposit in the chancery, ten days before of hearing, acts concerning the challenge and notification of violation, to make a decision.

The parties can attend court hearings, without lawyers.

The Peace Officer can:

  • declare unacceptable the appeal, for example,  appeal sent later or territorial Incompetence;
  • accept the appeal annulling all or part of the penalty;
  • confirm the penalty if the appellant not attend court hearing without valid reason (except that the illegality of the fine results from the documentation attached by the appellant);
  • not accept the appeal and the appellant must pay an other  fine  with an amount between the minimum and maximum established by law for the challenged violation

If the appeal is not accepted the payment must be done within 30 days from the notification of judgment.

Please note

The judgment of the  Peace Officer is appealable in the Court.
