Appeal to Prefect

 

Ways to present the appeal

The offender or other  person liable for the payment of the report can present an appeal to Prefect of Siena within 60 days from the challenge or notification of  violation report.

The appeal can be presented:

  • Directly to the Prefect (address: Piazza Duomo 9, 53100, Siena) sent by international registered post. The Prefect will send to  Provincia di Siena the appeal with the attached document  of the appelant. The responsible  office  will send to the Prefect all technical useful elements  to decide the validity or not of the appeal.
  • To the Highway Code Fines Office of Provincia di Siena  sent by international registered post, certified electronic mail (PEC) (here contact details).

The user when writes the appeal can ask a personal hearing to the Prefect.

Please note

  • The appeal to the Prefect sent later than 60 days from the date of the  notification  of the report is unacceptable.
  • It is not permitted to present the appeal to the Prefect if the violation report is paid. The payment of the fine is the accepting the violation report.
  • Whether there is  a supplementary sanction (generally suspended driver's license), it is not possible to send an appeal against only this sanction, but against the overall violation report .

What can decide the Prefect

The Prefect checks the appeal and the attached documents, considers the acts of the Police Jurisdiction of verifier.  After listening to the people that ask a personal hearing, the Prefect shall take its decision.

The Prefect can:

  • Declare unacceptable the report , if the appeal to the Prefect sent later.
<>··The Prefect order must be issued:
(a) within 180 days, if the appeal is presented directly to the Prefect;
(b) within 210 days, if the appeal is submitted  by the verifier.

When these terms have passed without the decision of the Prefect , the appeal is automatically accepted.

  • The notification of the Prefect order to the appelant will be send within 150 days from its issuing.
  • Against the payment order isued by the Prefect, the citizen can send the appeal to the Peace Officer within 30 days from the notification.
